These Terms & Conditions (“Terms”) apply when you purchase products, digital content or membership services from Scentwork Badge Club.
Please read these Terms before making a purchase. By placing an order or purchasing a membership or digital product, you agree to these Terms.
Nothing in these Terms affects any rights you have under applicable consumer law.
1. About us
Scentwork Badge Club is operated by Zita Polgar, a sole trader trading as Scentwork Badge Club.

Our main website and physical-product shop are hosted using Squarespace. Our digital training products and Scentwork Badge Club membership are hosted using MemberVault.
2. Who can purchase from us
You must be at least 18 years old and legally capable of entering into a contract to make a purchase from us.
If someone under 18 participates in activities or training provided through Scentwork Badge Club, an adult remains responsible for their participation and for the dog involved.
3. Our products and services
We may offer:
physical products, including badges, books, logbooks, bandanas and display items;
digital training products and resources;
monthly or annual Scentwork Badge Club memberships;
physical welcome packs supplied with certain membership options; and
other products, resources or membership benefits described on our website.
The exact contents, features and benefits of a product or membership are those described on the relevant sales page at the time you purchase.
We may change or update the products and memberships we offer from time to time.
4. Prices and payment
Prices will be displayed before you complete your purchase.
Any applicable delivery charges or other required charges will be shown or calculated during checkout where applicable.
Payments are processed using Stripe. We do not normally receive or store your complete payment card details.
You are responsible for providing accurate payment, billing and other information.
If a payment cannot be processed, we may be unable to fulfil an order or may suspend access to a paid digital product or membership until payment has been resolved.
5. Physical products
Physical products are purchased through our online shop hosted by Squarespace unless otherwise stated.
We take reasonable care to describe and display our products accurately. However, colours and appearance may vary slightly depending on your screen, and handmade, printed, woven or manufactured products may have minor variations.
Product availability is subject to stock.
If we are unable to fulfil an order, we will contact you and, where appropriate, refund any amount paid for the unavailable item.
6. Delivery
We offer delivery to the destinations shown as available during checkout.
Estimated delivery times are estimates rather than guarantees unless we have expressly agreed a particular delivery date with you.
We are not responsible for delays caused by circumstances outside our reasonable control, although this does not affect any statutory rights you may have regarding delivery.
You are responsible for providing a complete and accurate delivery address.
If an order is returned to us because an incorrect or incomplete address was supplied, or because delivery was not accepted or collected, we may require payment of reasonable additional delivery costs before resending the order.
International orders
We offer international shipping to destinations made available through our checkout.
International orders may be subject to customs duties, import taxes, handling charges or other fees imposed by the destination country.
Unless stated otherwise at checkout, these charges are not included in the purchase price or delivery charge and are the responsibility of the recipient.
Customs procedures may also cause delays outside our control.
7. Returns and cancellation of physical-product orders
If you are a consumer purchasing online, you may have a legal right to change your mind and cancel your purchase within a specified period.
For most eligible physical goods purchased by UK consumers at a distance, this is generally 14 days from receiving the goods.
If you exercise a statutory cancellation right, you must notify us within the applicable cancellation period.
You must then return the relevant goods in accordance with the applicable legal requirements.
Unless the goods are faulty or we are otherwise legally responsible for the return costs, you may be responsible for the cost of returning unwanted goods.
You are entitled to inspect goods in a way that would reasonably be possible in a shop. We may be entitled to make an appropriate deduction from a refund if goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning and their value has been reduced as a result.
Certain products may be excluded from the statutory right to change your mind where an applicable legal exception applies. Any relevant exclusion will be explained before purchase where required.

8. Faulty or incorrectly supplied physical products
Your statutory rights are not affected by these Terms.
Goods supplied to consumers must meet the standards required by applicable consumer law, including being as described, of satisfactory quality and fit for any particular purpose that we have agreed with you.

Your legal remedies will depend on the circumstances and applicable law.
9. Digital products
Digital products and online training materials are generally provided through MemberVault.
You may need to create an account to access them.
Unless expressly stated otherwise, purchasing digital content gives you a limited, personal, non-exclusive, non-transferable licence to access and use that content for your own personal purposes.
Purchasing access to digital content does not transfer ownership of the content or its intellectual property rights to you.
10. Cancellation rights for digital content
Different cancellation rules can apply to digital content supplied online.
Where you request immediate access to digital content during a statutory cancellation period, we may ask you to expressly consent to supply of the digital content beginning immediately and to acknowledge that this may affect or cause you to lose your statutory right to cancel once supply begins.
Where required by law, this consent and acknowledgement will be obtained as part of the purchase process.
Nothing in these Terms affects your statutory rights if digital content is faulty, not as described or otherwise fails to meet the standards required by applicable consumer law.
11. Scentwork Badge Club membership
Scentwork Badge Club membership provides access to the benefits described for the membership option selected at the time of purchase.
Depending on the membership option, benefits may include digital training content, training activities, member resources, community access, discounts and physical welcome items.
Membership benefits may evolve over time. We may make reasonable changes to content, exercises, resources or features provided that we do not materially reduce the core service you have purchased without an appropriate reason or remedy.
12. Monthly and annual subscriptions
Memberships may be offered on a monthly or annual subscription basis.
The price and billing interval will be clearly displayed before you purchase.
Memberships automatically renew unless you cancel renewal.
By purchasing an automatically renewing membership, you authorise us and our payment provider to take the applicable membership payment at each renewal using your selected payment method until you cancel.
You can cancel future renewal through your membership account.
If you cancel, your membership will normally remain active until the end of the period you have already paid for. Your membership will then end and no further renewal payment will be taken.
Cancelling your subscription does not normally result in a refund for the remaining portion of an already-paid membership period unless you have a legal right to a refund.
We will provide any renewal information, reminders or cancellation rights required by applicable law.
13. Changes to membership prices
We may change membership prices from time to time.
A price change will not retrospectively alter the price of a membership period that you have already paid for.
Where a price change will apply to a future automatic renewal, we will provide any notice required by applicable law and give you an appropriate opportunity to cancel before the new price is charged.
14. Membership welcome packs
Certain membership options include a physical welcome pack.
The contents of the welcome pack are those described for the relevant membership option at the time of purchase and may differ between membership types or change over time.
Where a welcome pack forms part of a new membership purchase, it will be sent using the delivery information provided in connection with that purchase.
A former member who later purchases a new membership may receive the welcome pack associated with that new membership purchase.
However, welcome packs are intended as a benefit accompanying genuine membership purchases. We reserve the right to limit or refuse repeated welcome packs where we reasonably believe that memberships are being repeatedly purchased and cancelled primarily to obtain additional physical welcome items or otherwise to misuse an offer.
This does not affect your statutory consumer rights.
15. Member discounts
Membership may include discounts on eligible Scentwork Badge Club products.
Discounts:
are for the member's own use unless expressly stated otherwise;
may apply only to specified products;
cannot normally be exchanged for cash;
may not be combined with other promotions unless stated; and
are available only while the relevant membership is active.
We may change the products to which a membership discount applies, provided this does not unfairly deprive members of a material benefit that formed part of their purchase.
16. Accounts and account security
You are responsible for keeping your account details and password secure.
Membership and digital-product accounts are for the registered customer's personal use.
You must not:
share your login details with another person;
allow another person to use your account to access paid materials;
attempt to bypass access restrictions;
give, sell or transfer your account to another person; or
use another member's account without permission.
Please contact us if you believe your account has been accessed without authorisation.
17. Intellectual property
Unless expressly stated otherwise, the content provided through Scentwork Badge Club belongs to us or is used by us with permission.
This includes, where applicable:
training exercises and written instructions;
videos and photographs;
course and membership materials;
Badge Club resources;
downloadable materials;
books and logbook content;
graphics, illustrations and designs;
badge designs;
website content; and
other original materials.
Our intellectual property remains ours even when you purchase a physical product, digital product or membership.
Unless expressly permitted, you may not copy, reproduce, republish, distribute, sell, sublicense, upload, publicly share or commercially exploit our materials.
You may make reasonable personal use of materials as intended as part of your purchase.
18. Use by dog trainers and other professionals
Unless we expressly agree otherwise, standard customer purchases and memberships are licensed for personal use and do not give dog trainers, instructors or other professionals permission to reproduce or commercially use Scentwork Badge Club materials with clients.
Trainers participating in our approved affiliate programme may be permitted to use specified Scentwork Badge Club materials and activities with their clients.
Such use is subject to the rules and terms of the affiliate programme in addition to these Terms.
Participation in the affiliate programme does not transfer ownership of our intellectual property to the trainer and does not give permission to reproduce, resell or distribute our materials except as expressly permitted by the affiliate programme.
19. Community areas
Membership may include access to community features that allow members to post comments, photographs, videos, training updates or other content.
You remain responsible for content you submit.
You must not use our community areas to:
harass, threaten or abuse another person;
post unlawful, discriminatory, defamatory or deliberately harmful content;
infringe another person's intellectual property or privacy rights;
post content that you do not have permission to share;
advertise or spam other members without permission;
attempt to obtain another member's account or private information; or
otherwise seriously disrupt the community.
We may moderate or remove content where we reasonably believe it breaches these rules or where removal is reasonably necessary to protect members, the community or the Scentwork Badge Club.
Serious or repeated misuse may result in suspension or termination of community or membership access.
Where reasonably possible and appropriate, we will consider the seriousness of the breach before terminating paid access.
20. Content you submit
You retain ownership of photographs, videos, comments and other original content you submit through our services.
By posting content within functionality that is intended to display it to other members, you give us permission to host, store and display that content as reasonably necessary to operate that functionality.
We do not obtain a general right to use member-submitted photographs or videos for advertising, social media or promotional purposes simply because they were uploaded to the membership platform.
If we would like to use your content for a separate promotional purpose, we will seek appropriate permission.
21. Dog training and educational information
Scentwork Badge Club provides educational information and activities relating to dog scentwork and enrichment.
Dogs are individuals, and not every activity, environment or training approach will be appropriate for every dog.
You are responsible for deciding whether an activity is appropriate for your dog and circumstances.
You should take into account factors including your dog's age, physical condition, behaviour, training experience, environment and emotional state.
Exercises should be adapted where necessary to suit the individual dog.
You should stop or modify an activity if your dog shows signs of distress, discomfort, fear, excessive frustration or physical difficulty.
22. Veterinary and professional advice
Scentwork Badge Club materials are not a substitute for individual veterinary diagnosis or treatment.
If you have concerns about your dog's health, pain, physical ability or suitability for an activity, you should seek advice from an appropriately qualified veterinary professional.
General training information also cannot account for every individual behavioural situation. Where a dog presents behaviour that creates a significant safety or welfare concern, appropriate individual professional advice should be sought.
23. Training environments and search areas
You are responsible for choosing safe and appropriate environments in which to carry out Scentwork Badge Club activities.
Before using a location as a search or training area, you should consider potential hazards to your dog, yourself, other people and property.
You must have any permission required to enter, access or use a location for training.
Participation in a Scentwork Badge Club activity does not give you permission to enter private property, restricted areas or locations where dogs or the proposed activity are not permitted.
You are responsible for complying with applicable laws, rules, access restrictions and instructions from landowners or site operators.
24. Your responsibility for your dog
You remain responsible for the supervision, handling, welfare and safety of your dog while undertaking Scentwork Badge Club activities.
You are also responsible for taking reasonable precautions to prevent injury or damage to other people, animals or property.
Nothing in our materials should be interpreted as requiring you to undertake an activity that you reasonably consider unsafe or inappropriate.
25. Suspension or termination by us
We may suspend or terminate access to an account or membership where reasonably necessary, including where:
payments remain unpaid;
an account is being shared or used fraudulently;
our intellectual property is being copied or distributed without permission;
a member seriously or repeatedly breaches our community rules;
our services are being used unlawfully; or
there has been another serious breach of these Terms.
Where appropriate, we will try to give you an opportunity to resolve a breach before terminating paid access, although we may act immediately where reasonably necessary to protect people, animals, our intellectual property, our systems or other members.
Any refund entitlement following termination will depend on the circumstances and your statutory rights.
26. Availability of digital services
We aim to keep our digital products and membership services reasonably available, but we cannot guarantee uninterrupted access at all times.
Access may occasionally be interrupted by maintenance, technical problems, updates, third-party platform outages or circumstances outside our reasonable control.
We will take reasonable steps to address material problems within our control.
Nothing in this section limits your statutory rights where a paid digital service fails to meet legal requirements.
27. Third-party platforms and links
Parts of our services are provided using third-party platforms, including Squarespace, MemberVault and Stripe.
Our websites and membership areas may also contain links to third-party websites or services.
We are not responsible for the content or independent practices of third-party websites that are outside our control.
Our use of personal information and third-party service providers is explained further in our Privacy Policy.
28. Refunds
Except where expressly stated otherwise, we do not offer additional contractual refund rights beyond those provided by applicable law.
This does not mean that purchases are non-refundable in all circumstances.
You may be legally entitled to a refund, repair, replacement, price reduction, cancellation or another remedy depending on the product, the circumstances and applicable consumer law.
Nothing in these Terms excludes or restricts those rights.

29. Our responsibility to you
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where required by law.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.
Scentwork Badge Club products and services are primarily supplied to consumers for personal use.
If you use a product or service for commercial purposes outside an arrangement expressly agreed with us, we are not responsible for business losses such as loss of profit, revenue, business opportunity or anticipated savings to the extent permitted by law.
30. Events outside our reasonable control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control.
These may include postal or courier disruption, severe weather, natural disasters, failures of third-party infrastructure or online platforms, industrial action or other events that we could not reasonably prevent.
Where such an event materially affects our ability to fulfil our obligations, we will take reasonable steps to minimise the impact and communicate with affected customers where appropriate.
Your statutory rights remain unaffected.
31. Changes to these Terms
We may update these Terms from time to time, including to reflect changes to our products, membership services, technology or applicable law.
The Terms that apply to a particular one-off purchase will generally be those in effect when that purchase was made.
For ongoing memberships, we may make reasonable changes to these Terms. Where a change materially affects your rights or obligations, we will provide reasonable notice where required and any cancellation rights required by applicable law.
The latest version will be published on our website with its effective date.
32. Privacy
We process personal information in accordance with our Privacy Policy.
Please read that policy for information about the personal information we collect, how we use it, the services we use and your data protection rights.
33. Complaints

We will try to resolve complaints fairly and within a reasonable period.
Nothing in this section prevents you from exercising any statutory consumer rights available to you.
34. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or another country, you may also benefit from mandatory consumer protections under the laws that apply where you live. Nothing in these Terms is intended to remove rights that applicable law does not allow you to waive.
Any dispute may be brought before the courts with jurisdiction under applicable law.
